First steps for California drivers

After an Accident

An accident can leave you unsure what to do next. This guide explains the first steps to take, important reporting requirements, and your options when arranging repairs.

  1. Stop and put safety first

    Stop at the scene. Call 911 if anyone is injured or there is an immediate emergency. If nobody is injured and it is safe to do so, move your vehicle out of traffic. Exchange the required information before leaving.

  2. Exchange information and document the scene

    Exchange names, contact information, driver’s license details, vehicle registration, and insurance information. When safe, photograph the vehicles, damage, license plates, road conditions, and traffic signs. Collect witness contact details and preserve any dashcam footage. Describe what you know accurately; avoid guessing or signing statements accepting fault at the scene.

  3. Check police reporting requirements

    If anyone is injured or killed, California generally requires a written accident report to CHP or the appropriate city police department within 24 hours. Contact the agency to confirm how the reporting requirement is being handled and obtain the report number if available.

  4. File a DMV report when required

    An SR-1 report must be submitted to DMV within 10 days if anyone was injured—even slightly—or killed, or if property damage exceeded $1,000.

    This requirement applies regardless of fault and can apply to collisions on private property. A police report or insurance claim does not replace the SR-1. You or an authorized representative must submit it.

  5. Notify your insurance company

    Report the accident promptly and keep your claim number and adjuster’s contact details. Ask about your deductible, towing, storage, rental coverage, and any applicable limits. Keep copies of communications and receipts. Coverage and payment depend on your policy and the claim investigation.

  6. Understand your repair choices

    You have the right to choose your auto body repair shop. Your insurer cannot require you to use a particular shop. Choosing a shop does not automatically mean every quoted charge will be covered.

    Before authorizing work, review the estimate and ask about any inspection, disassembly, or other charges. The shop must obtain your authorization before starting repairs and obtain authorization for additional work. Keep the final invoice.

  7. Get independent legal guidance when needed
